Terms of Service

1. Acceptance of Terms

YouBrokeProd ("the Service") is operated by RoboticForce, Inc., a company incorporated in the Province of Ontario, Canada ("RoboticForce", "we", "us", or "our"). The Service is an online platform that provides simulated production incident training for software engineers and DevOps professionals.

By accessing or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not access or use the Service. We reserve the right to update or modify these Terms at any time. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Terms

You may use certain features of the Service without creating an account. To access the full feature set, including progress tracking and leaderboards, you must create an account by providing a valid email address or by authenticating through a supported OAuth provider (GitHub or Google).

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@youbrokeprod.com if you suspect any unauthorized access to or use of your account.

We reserve the right to refuse registration, cancel accounts, or remove or edit content at our sole discretion.

4. Acceptable Use

You agree not to:

  • -Use the Service for any unlawful purpose or in violation of any applicable federal, provincial, or local laws
  • -Attempt to reverse engineer, decompile, disassemble, or extract source code from the Service
  • -Use automated scripts, bots, or other tools to interact with the Service in a way that imposes unreasonable load on our infrastructure
  • -Share, transfer, or sell account credentials to other users
  • -Submit false, misleading, or fraudulent information
  • -Interfere with or disrupt the integrity, performance, or security of the Service
  • -Attempt to gain unauthorized access to any portion of the Service, other user accounts, or related systems
  • -Use the Service to distribute malware, spam, or other harmful content
  • -Circumvent any access controls, rate limits, or usage restrictions

Violation of these terms may result in immediate suspension or termination of your account without prior notice.

5. Intellectual Property

The Service and all of its content, including but not limited to scenarios, text, graphics, logos, icons, audio, software, and design elements, are the exclusive property of RoboticForce, Inc. and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal or internal business training purposes. This licence does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from any content on the Service without our prior written consent.

Any feedback, suggestions, or ideas you provide to us about the Service may be used by us without obligation or compensation to you.

6. Payment Terms

Certain features of the Service may require a paid subscription. All fees are stated in the currency indicated at the time of purchase and are non-refundable except as required by applicable law.

Payment processing is handled by Stripe. By submitting payment information, you agree to Stripe's terms of service. We do not store your full payment card details on our servers.

We reserve the right to change our pricing at any time. If you are on a subscription plan, we will provide at least 30 days' notice before any price increase takes effect on your account.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

RoboticForce, Inc. does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. All scenarios, systems, and incidents presented in the Service are simulations for educational purposes only and do not represent actual production infrastructure.

We make no guarantees regarding the accuracy, reliability, or completeness of any content provided through the Service, including any training material, scenario outcomes, or scoring.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE LAWS OF THE PROVINCE OF ONTARIO AND THE FEDERAL LAWS OF CANADA APPLICABLE THEREIN, ROBOTICFORCE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR ANY OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF ROBOTICFORCE, INC. FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN CANADIAN DOLLARS (CAD $10.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless RoboticForce, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit or transmit through the Service.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, conduct that we determine is harmful to other users or to us, or any other reason at our sole discretion.

You may terminate your account at any time by contacting us at legal@youbrokeprod.com. Upon termination, your right to access and use the Service will immediately cease.

The following sections survive termination of these Terms: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provisions that by their nature should survive.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, and you hereby consent to the personal jurisdiction of such courts.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at legal@youbrokeprod.com. We will make good-faith efforts to resolve the dispute within 30 days.

12. Severability

If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RoboticForce, Inc. regarding your use of the Service. These Terms supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter herein.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. For significant changes, we may also notify you by email. Your continued use of the Service after any such changes constitutes your acceptance of the revised Terms.
